Zoning Law and Plan Objections

The value of a plot is determined less by its title deed than by what the zoning plan allows on it. Plan amendments and permit decisions belong to the administrative courts, and the deadlines are short.

Turkish zoning plans are placed on public display for one month before they become final, and objections may be lodged during that period (Zoning Act no. 3194, art. 8). If the objection is rejected or goes unanswered, an action for annulment is brought before the administrative court; the general time limit for administrative actions is sixty days. Work-stop notices, demolition orders and zoning fines are challenged by the same route. Once the deadline passes, the lawfulness of the act can no longer be examined.
